Terms of use
1. Who these terms are for
These terms of use apply to everyone with an account in a Bouwivo environment: employees of a business that uses Bouwivo ("Users") and customers and dealers to whom that business gives access to the B2B ordering portal ("Portal Users"). We refer to the business that invited you as "your principal". By activating or using your account you accept these terms. The relationship between Bouwivo and your principal is governed by the terms and conditions.
2. Your account
- Your account is personal. Do not share your password or two-step verification codes with anyone and do not use someone else's account.
- Choose a strong password that you do not use anywhere else. The password for the customer portal mijn.bouwivo.nl and the password for a Bouwivo environment belong to different accounts.
- If you suspect someone else is using your account, change your password immediately and report it to your principal and to info@bouwivo.nl.
- Your principal decides which permissions you have and can block or delete your account at any time.
3. What is not allowed
- Using the Service in breach of the law or the rights of others, or for any purpose other than work for, or orders with, your principal.
- Trying to access data, features or environments for which you have no permission, testing or circumventing security, or overloading the Service, for example with automated requests.
- Entering malicious software, unlawful, misleading or offensive content, or personal data of others without being authorised to do so.
- Copying, decompiling or replicating the software or using it to build a competing product.
4. Orders via the B2B ordering portal
An order you send via the portal is a request to your principal. Whether and at what price and on what terms the order is accepted, delivered and invoiced is agreed exclusively with your principal. Bouwivo is not a party and is not responsible for prices, lead times, delivery, quality, warranty or payment. Check dimensions and choices before sending; the status and timeline in the portal show the information your principal enters.
5. Data and privacy
The data in the environment belongs to your principal, who is responsible for processing your personal data. Bouwivo processes it on your principal's behalf. Bouwivo sends invitations and password links on behalf of your principal to the e-mail address your principal entered. More information is in the privacy statement.
6. Availability and liability
Bouwivo provides the Service as is, without guarantee that it is always free of errors or available. Calculations, dimensions and prices in the Service are tools; check them yourself. Bouwivo, its owner, directors and employees are not liable towards Users and Portal Users for damage caused by the use of the Service, except in case of intent or deliberate recklessness or to the extent the law does not permit this. Arrangements on damage between you and your principal are not affected.
7. Blocking
Bouwivo and your principal may block your account or restrict access in case of (suspected) misuse, a security risk or a breach of these terms.
8. Changes and governing law
Bouwivo may change these terms of use; the current version is on this page. These terms are governed by Dutch law. Disputes are submitted to the competent court of the District Court of East Brabant, unless mandatory law designates another court.
